To the extent allowed by law, TDT DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. Furthermore, to the extent allowed by law, under no circumstances shall TDT be liable to the owner or any other person for any consequential damages, whether arising out of breach of warranty, breach of contract, negligence, or otherwise. Installation of this product in a structure clad in an Exterior Insulation and Finish System (“EIFS”) or Direct-Applied Exterior Finish System (“DEFS”) – both known commonly as synthetic stucco – which does not provide an adequate drainage plane behind the surface of the cladding VOIDS all warranties contained herein TO MAKE A WARRANTY CLAIM the owner must submit to TDT in writing within 120 days of notice of the alleged defect(s) a detailed description of the alleged defect(s) as well as the owner’s name, address, and telephone number. TDT reserves the right to inspect this product to determine the validity of such a claim, and, in any event, is not responsible for installation, reinstallation, painting, materials, freight or other labor or costs associated with replacement parts. The warranties contained herein are the owner’s sole and exclusive remedy under any warranty, contract, negligence, or other claim.
